In Australian family law, strict deadlines apply to property settlement and spousal maintenance. Missing these deadlines can significantly affect your rights.
What are the Time Limits for a Property Settlement?
The time limit depends on whether you were married or in a de facto relationship.
Married Couples
If you were married, you must apply for a property settlement or spousal maintenance within 12 months from the date your divorce becomes final.
De Facto Couples
If you were in a de facto relationship, the time limit is two years from the date of separation.
When Does Separation Actually Occur?
Separation is not always straightforward.
It generally occurs when:
- One or both parties form the intention to separate, and
- That intention is communicated.
Importantly, you can be “separated under one roof”, meaning you still live together, but are no longer in a relationship.
What Happens If You Miss the Deadline?
If you do not commence proceedings within the relevant time limit, you must seek permission from the Court to proceed out of time. This is not automatic.
You will need to show:
- Hardship would be caused if leave is not granted, and
- A reasonable explanation for the delay.
Even where these factors are established, there is no guarantee that leave will be granted.
Do Time Limits Apply if You Reach Agreement?
Time limits still matter even if you are negotiating.
To properly protect your position, any agreement should be formalised by:
- Consent Orders, or
- A Binding Financial Agreement.
Delaying this step can create risk if the time limit expires.
